Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Daily Delta mobile application and website (collectively, the "Service"), operated by Daily Delta ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are between 13 and 18 years of age, you represent that you have your parent or legal guardian's permission to use the Service and that they have read and agreed to these Terms on your behalf.
2. Accounts
You must create an account to access the full features of the Service. You may register using an email address and password or by signing in with your Google account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@dailydelta.app if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Submit images, text descriptions, or barcodes that violate any applicable law or regulation
- Submit content containing personally identifiable information of third parties without their consent
- Attempt to reverse engineer, decompile, or disassemble any part of the Service
- Use automated means to access the Service, including bots, scrapers, or scripts
- Circumvent or attempt to circumvent scan limits, subscription gates, or other access controls
- Impersonate another person or entity
- Interfere with or disrupt the integrity or performance of the Service
- Use the Service to transmit harmful, offensive, or malicious content
4. Subscriptions and Billing
The Service is offered in a free tier and a paid Pro tier. The free tier is ad-supported and subject to daily scan limits. The Pro tier is a recurring monthly subscription billed through Google Play.
Free tier. Free-tier users may submit up to 10 scans per day and may view up to their last 30 scan entries. The free tier is ad-supported via Google AdMob. Free-tier scans are analyzed using the GPT-4.1 Mini AI model.
Pro tier. Pro subscribers receive effectively unlimited daily scans, no ads, up to 500 entries of scan history, access to weekly AI-written digests, history export, and analysis using the GPT-4.1 AI model. Pro subscriptions are currently priced at $2.99/month and are subject to change with at least 30 days' notice.
Billing. Pro subscriptions are processed by Google Play. By subscribing, you authorize Google Play to charge your payment method on a recurring monthly basis until cancelled. Subscription status is verified server-side; the client is never trusted to self-report a Pro status.
Cancellation. You may cancel your Pro subscription at any time through your Google Play account. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial months.
Refunds. Refund requests for in-app purchases are handled by Google Play per their refund policy. We do not process refunds directly.
Price changes. We reserve the right to change subscription pricing. We will provide at least 30 days' notice of any price change via email or in-app notification.
5. Content Submission and Processing
The Service allows you to submit content for AI analysis in three ways: by taking or uploading a photo, by typing a text description of an item, or by scanning a product barcode. By submitting content, you acknowledge and agree that:
- Your submission will be transmitted to and processed by our backend service (hosted on Cloudflare Workers) and by OpenAI's API
- Submitted images will be stored in our cloud storage (Supabase) and automatically processed by our privacy redaction pipeline, which strips EXIF metadata and pixelates any detected persons in the image
- A processed derivative image will be stored in addition to your original upload
- Barcode values may be used to look up product information from USDA FoodData Central and Open Food Facts
- Technical metadata about each submission (device OS, app version, timezone, file size, SHA-256 hash, source type) is recorded as part of your scan record
- On first use, you will be asked whether you consent (entirely optional, off by default) to allow your de-identified scan data — product names, barcodes, category and nutrition data, AI-generated scores, and privacy-redacted images with faces and personal information removed — to be used for commercial purposes, including licensing or selling aggregated, de-identified datasets to third parties as described in Section 7 and our Privacy Policy; never your identity or images containing a recognizable face. You may change this preference at any time in Settings → Data & Privacy
6. AI-Generated Content
The scores, tips, summaries, and weekly digests generated by the Service are produced by artificial intelligence and are provided for informational purposes only. They do not constitute medical, nutritional, financial, or environmental advice. You should not make health or financial decisions based solely on the output of the Service.
We make no warranties regarding the accuracy, completeness, or reliability of AI-generated content. Results may vary depending on image quality, text clarity, barcode availability, and the AI model's assessment. Results should be interpreted as general directional guidance only.
7. Intellectual Property
The Service and all of its content, features, and functionality — including but not limited to the software, design, trademarks, and logos — are owned by Daily Delta and are protected by applicable intellectual property laws.
You retain ownership of the images and text you submit to the Service. By submitting content, you grant us a limited, non-exclusive, royalty-free license to process, analyze, and store that content for the purpose of providing the Service to you, including operating our privacy redaction pipeline.
Commercial data license (opt-in only). If, and only if, you opt in to commercial data use, you additionally grant Daily Delta a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, aggregate, create derivative works from, and commercially exploit your de-identified scan data — including product names, barcodes, category and nutrition data, AI-generated scores and trends, and privacy-redacted images from which faces and personal information have been removed — including to create, license, sell, and transfer aggregated, de-identified datasets to third parties. This license covers only de-identified, redacted data and never data that identifies you personally. You may withdraw from commercial data use at any time in Settings → Data & Privacy; withdrawal ends future use but, because the license is sublicensable and transferable, does not revoke rights already granted in datasets created, licensed, or transferred before withdrawal. We do not use your submitted content to train AI models operated by third parties, including OpenAI.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DAILY DELTA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING FROM OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $10.00, WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify, defend, and hold harmless Daily Delta and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another party.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our discretion.
Upon termination, your right to use the Service ceases immediately. Sections 7 through 14 of these Terms survive termination.
12. Assignment and Business Transfers
You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms, and any rights and licenses granted under them — including the commercial data license in Section 7 and any de-identified datasets — to a successor or acquiring entity in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our assets, without notice to or consent from you. These Terms bind and benefit the parties and their permitted successors and assigns.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in San Diego County, California, and you consent to the personal jurisdiction of such courts.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the effective date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
